All sales are pursuant to the provisions of the Ohio Revised Code. Sales, when held, are on Friday mornings starting promptly at 10:00 A.M. in the Community Room on the first floor of the People’s Community Center building, 597 Park Avenue East, Mansfield, Ohio 44905. There are no Sheriff’s Sales on Federal Holidays.  The official listing of upcoming properties to be sold can be found in The Shelby Daily Globe (three weeks in advance of the sale). The list on this website is for informational purposes only.  A complete list of withdrawals is read at the beginning of each respective Sheriff’s Sale. The information on our website is a courtesy and should be verified for accuracy.

 

CONDITIONS OF THE SALE

 

All bids for a bank foreclosure begin at 2/3 of the appraised value of the property unless dictated otherwise by the Courts.  If you purchase a property, you will need either a cashier’s check or personal check in the amount of the required deposit. Balance will be due according to the terms of the sale. All sales stipulate “Buyer Beware”. Meaning that the inside of the house may not have been examined by an appraiser because access was not made available, and the sale could be set aside because of significant damage inside the house. If you are the successful bidder, a Purchaser Information Form must be filled out prior to the purchase of the property. A deed will be prepared by the Plaintiff’s Attorney once a copy of your confirmation of sale is prepared. Deeds take approximately 4 to 12 weeks.

 

TERMS OF BANK SALE:  If the appraised value of the property is less than or equal to $10,000 the deposit is $2,000.  If the appraised value of the property is between $10,001- $200,000 the deposit is

$5,000. If the appraised value is greater than $200,000 the deposit is $10,000.

 

A court order is required to withdraw a property from sale. Withdrawal orders received by our office prior to the week of any scheduled sale are noted on our website. Withdrawals received the week of the sale are NOT updated on the website. This list is updated every Wednesday.

SHERIFF’S SALE TERMS FOR BANK FORECLOSURES AND TAX

FORECLOSURES IN RICHLAND COUNTY

 

You, being the buyer, should have thoroughly investigated the property that you have purchased.   You are aware of the property location, the condition of the property, and are aware that the inside of the house may not have been examined by the appraiser, if access was not made available.

 

You, being the buyer, understand that if you are the successful bidder on a bank foreclosure, a deposit of your bid will be due according to the appraised value, today immediately following the sale.

 

You, being the buyer, understand that if you are the successful bidder on a tax foreclosure, the balance will need to be paid in full today immediately following the sale.

 

The Sheriff’s Office is not responsible for any water or sewer bills that are due on the property. This also includes sewer assessments.  If the property is in the City of Mansfield, it has been past practice that the city does not hold the new buyer responsible, the bill goes with the person, not the property.  However, in any case the new buyer would be responsible if the city was to change policy or if the residence is not in the City of Mansfield.  Also, you understand that you need to check with the different utility companies’ reference past bills and that you may be responsible for those.

 

The real estate taxes are pro-rated in a sheriff’s sale.  The delinquent taxes will be paid from the proceeds of the sale, but you are responsible for the current taxes, which are always 12 months in arrears in Richland County.

 

Even though you are the successful bidder on the property today, you have put a deposit on the property or purchased it in full, you understand that the property is not in your possession until the judge has confirmed the sale and ordered a deed to be made in your name.  This means that you are not the owner of the property until that time. Once the new deed is in your name, has been conveyed and transferred, then you are legally the new owner. Until that time, you are not permitted to enter the residence, tell an occupant to leave, mow the yard, change the locks, etc.

 

Until the new deed is issued in your name, you understand that the previous owner may redeem the property. If this were to occur, you would receive your deposit back.

 

You understand that the sheriff’s office does not wait for any bank closings in a sheriff’s sale. The bank cannot be permitted inside the residence for an appraisal and you know where your funds are coming from.   You understand that when the sheriff’s office calls to let you know that the deed is ready you need to have the balance in full ready at that time if not, you stand to lose your deposit and will be in contempt of court.

 

You understand that the deed may not be ready for as little as four weeks to up to four weeks depending on the case


Question and Answer

Can a pre-approved loan take the place of the down payment?
No. The terms of the sale are personal check, cashiers check or money order.

Can I go through the property?
No. The property is owned by the defendant until the sale has been confirmed by the court. The buyer purchases any foreclosed property caveat emptor, which means, "let the buyer beware" or that you are buying the property sight unseen. Remember, deposits are not refunded.

When can I go into the property?
You may enter the property once the court has confirmed the sale, you have paid for the property in full and you have received the deed and the deed has been recorded and conveyed. Until that time, you may not enter the property, change the locks, have occupants removed, mow the yard, etc.

What happens if the property is occupied?
After the confirmation has been filed, you have paid in full and received your deed and have recorded and conveyed the deed, you may contact the occupants and advise them they need to vacate the premises. If they still refuse then the buyer needs to file a writ of possession with the Richland County Clerk of Courts and in turn the Sheriff’s Office will serve the occupants with an order to vacate. If they still refuse to vacate, the buyer then needs to contact a moving company and a lock smith and the moving company will move out the occupants at the buyers expense. The Sheriff’s Office will stand by if this occurs, but usually the occupants leave prior to filing with the Clerks Office.

How can my mortgage company appraise the property for my loan?
The Sheriff’s Office does not have the authority to order the defendant to let anyone inside. The mortgage companies in this area are aware of the problems trying to appraise without going inside. The buyer must contact the mortgage company to work out those details.

Who schedules the closings?
The Sheriff’s Office does not attend closings. It is the responsibility of the purchaser or the purchasers agent to pay the balance due in full when contacted by the Sheriff’s Office. When the balance is paid, the purchaser will receive a Sheriff’s Deed, which then will be recorded by the Sheriff’s Office.

What are the additional costs of the sale, if any?
In a tax foreclosure, the buyer is responsible for the successful bid, deed fee for $50.00, poundage fee, conveyance of the deed for $75.00, and the recording of the deed to be paid to the Sheriff’s Office. 

 

In a mortgage foreclosure, some costs are taken from the sale. The successful bidder is responsible for the deed fee, conveyance fee and the recording fee to be paid to the Sheriff’s Office.

What is a conveyance fee?
A conveyance fee is where the Sheriff’s Office will transfer the sellers name to the buyers name. The fee is $4.00 per every $1,000 dollars of the total sale.

What is a recording fee?
A recording fee is where the Sheriff’s Office will have the Recorder’s record the deed for permanent record keeping. The fee is $28.00 for the first two pages, then $8.00 for each additional page.
